The Redsms text messaging system automatically applies a “blacklist” of numbers that do not wish to receive text messages, this can be a standard list or be defined by the organisation to screen numbers before the message is sent.

The system also automatically adds in an opt-out reply path to any text sent to ensure recipients have the option to opt out of future communications. This can be disabled when not needed, for example a customer services notification or an internal communication.

The key regulatory bodies you need to familiarise yourself with when
developing your database and sending texts are:

The Data Protection Act
The Privacy and Electronic Communications Regulations 2003.

The ICO (Information Commissioners Office) Link here also provide guides to ensure you stay within the law.
They state that organisations may not send a text message if the recipient has not agreed to it, unless;

  • The sender has obtained your details through a sale or negotiations for a sale.
  • The messages are about similar products or services offered by the sender.
  • You were given an opportunity to refuse the texts when your details were collected and,
    if you did not refuse, you were given a simple way to opt out in all the text messages you received.

So, when you are sending texts to existing customers follow the bullet points above. If you are sending texts to prospects then they have to have opted in to receive them first.
